Terms & Conditions

Please read these terms and conditions carefully before using our services.

  • By using our services, you agree to be bound by these terms of use.

  • Law Office of Marcia B Moulon retains the right to avoid a contract if the client concerned is not filling the entire conditions determined by the office.

  • The manner of performing legal services in a case entrusted to Law Office of Marcia B Moulon shall result from the type of case, the scope of the mandate as well as from current arrangements with the client.

  • In exchange for provision of legal services, Law Office of Marcia B Moulon shall receive a remuneration calculated on the basis of time spent in performing services unless a flat rate remuneration for a given service has been agreed upon.

  • Each of the Parties shall have the right to terminate the agreement concluded for an indefinite period of time with one-month's notice, to be effective as at the end of the calendar month. The termination of the agreement as a result of its termination by notice shall not influence the manner of settling the activities performed in the last month of the agreement's duration.

  • In the absence of an agreement to perform legal services fees shall be charged by way of time spent and Law Office of Marcia B Moulon shall invoice same accordingly.

  • The Parties undertake to resolve any disputes connected with the interpretation or performance of the agreement to provide legal services by way of mutual negotiations. If it is not possible to resolve a dispute in an amicable manner, the court of law shall settle the dispute.

  • In matters not governed by the agreement to provide legal services, while taking into account the content of the present General Terms and Conditions, provisions of law shall apply.

  • The lateness of payment of fees totally or partially for a period of 10 days, gives the Law Office of Marcia B Moulon the full right to cancel, stop or non-perusing the case and in this case Law Office of Marcia B Moulon may demand all indemnities and costs of time, hours spent, services already presented … etc.

Mandatory Retainer Agreement and payment provisions 

French Law, Article 10 of the Law of 31 December 1971 reads as follows:


 "The fees for court applications, hearings, consulting, support, counseling, drafting legal private documents and pleadings shall be agreed with the client.


As regards foreclosure, sharing, bidding and legal security, lawyer's fees and disbursements are fixed on the basis of the amount determined in accordance with arrangements provided for in Title IVa of Book IV of the Commercial Code.


Except in cases of emergency or force majeure or when an Attorney / Avocat intervenes under full legal aid or the third part of the law n ° 91-647 of 10 July 1991 on legal aid, the lawyer concludes in writing with his client a fee agreement, which states, inter alia, the amount or method of determining fees covering predictable procedures, as well as various fees and disbursements contemplated.


The fees take into account, according to usage, the client's financial situation, the difficulty of the case, the costs incurred by the lawyer, the Lawyer’s notoriety and her/his relevant diligences.


The setting of fees on a result-only or success-only is strictly prohibited. In addition to provision for fees and expenses, a legal agreement may also provide for the remuneration of the services provided and an additional fixed fee which is result-based or success-based, for the service rendered."

Mandatory recourse to an Ombudsman for consumers


French Law by way of Ordinance No. 2015-103 of 20 August 2015 on alternative dispute resolution for consumer disputes and Decree No. 2015-1382 of 30 October 2015 relating to mediation of consumer disputes establish the right for free access by consumer to an ombudsman for amicable resolution of disputes between a professional and contact information must be made available to consumers pursuant to article R. 156-1 of the Consumer Code. Consequently, in the unlikely event of dispute with their Avocat, clients may now contact the national mediator who has been appointed by the Conseil National des Barreaux (CNB).
